Terms and Conditions

These terms and conditions are governed by the law of the Hong Kong Special Administrative Region (“Hong Kong SAR”)

Article 1 – Definitions

For the purposes of these General Terms and Conditions, the following terms shall have the meanings given below:

Consumer: a natural person who is not acting in the course of a trade, business, or profession and who concludes a distance contract with the seller. Day: a calendar day. Distance contract: a contract concluded between the seller and the consumer using exclusively one or more means of distance communication, without the seller and consumer being physically present at the same time. Means of distance communication: any means that can be used to initiate or conclude a contract without the seller and consumer being physically present at the same time. Durable medium: any medium that enables the consumer or the seller to store information in a way that allows it to remain accessible for a reasonable period of time and to reproduce it unchanged. Fixed-term contract: a distance contract for the regular supply of goods and/or services over a defined period. General terms and conditions: these general terms and conditions of the seller. Withdrawal period: the period during which the consumer can exercise their right of withdrawal. Right of withdrawal: the consumer's right to withdraw from the distance contract within the withdrawal period. Seller / Entrepreneur: a natural or legal person who offers goods and/or services to consumers via distance selling.

Article 3 – Applicability

These terms and conditions apply to every offer made by the seller, as well as to every distance selling contract and order concluded between the seller and the consumer. The terms and conditions will be made available to the consumer before the conclusion of the distance selling contract. By placing an order, the consumer acknowledges and agrees that these terms and conditions, which are governed by the laws of Hong Kong SAR, apply to the transaction.

Article 4 – The Offer

If an offer is time-limited or subject to conditions, this will be clearly stated in the offer. The offer contains a complete and accurate description of the products and/or services offered. Obvious errors or mistakes in the offer are not binding on the seller. Illustrations, specifications, and other information serve only as examples and do not give rise to any claim for damages or contract termination.


Article 5 – The Treaty

The contract is concluded as soon as the consumer accepts the offer and fulfills the applicable conditions. If the offer is accepted electronically, the seller will immediately confirm receipt of the acceptance electronically. The consumer may cancel the contract until receipt of the acceptance has been confirmed. The seller will take appropriate technical and organizational measures to protect electronic data transmission and ensure a secure online environment.


Article 6 – Right of withdrawal

When purchasing products, the consumer has the right to withdraw from the contract within 30 days without giving any reason. The withdrawal period begins on the day after the consumer, or a person designated by the consumer, receives the goods. During the withdrawal period, the consumer must handle the goods and their packaging with care. The goods may only be inspected to the extent that would be customary in a retail store. The consumer must inform the seller of the withdrawal in writing or by email within 30 days of receiving the goods. After this notification, the consumer has a further 30 days to return the goods and provide proof of timely return. If no notification or return is made within the specified time, the purchase is considered final.




Article 7 – Costs of Cancellation

If the consumer exercises their right of withdrawal, they bear the direct costs of returning the goods. The seller will refund all payments made by the consumer within 5 working days of receiving the returned goods or upon presentation of sufficient proof of return, whichever occurs first.

Article 8 – Exclusion of the right of withdrawal

The seller may exclude the right of withdrawal for certain products and services, provided this is clearly stated in the offer before the conclusion of the contract. The exclusion may apply in particular to: – products manufactured according to customer specifications or clearly personalized; – sealed goods that are unsuitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery; – perishable goods or goods with a limited shelf life; – goods whose price depends on fluctuations in the financial market over which the seller has no control; – sealed audio or video recordings or computer software whose seal has been removed after delivery; – services whose performance has begun with the consumer's express consent before the end of the withdrawal period; – betting and lotteries.







Article 9 – Prices

During the validity period of this offer, prices will not be increased unless this is due to changes in applicable tax rates. Price increases within three months of the contract's conclusion are only permitted if they are based on legal regulations. After three months, price increases are only permitted if this has been agreed upon and the consumer is entitled to terminate the contract at the time the price increase takes effect. All prices include applicable taxes unless otherwise stated. Deliveries outside of Hong Kong SAR may be subject to import duties, customs duties, or additional charges, which are the responsibility of the consumer. Obvious pricing errors are not binding on the seller.




Article 10 – Conformity with the Contract and Guarantee

The seller warrants that the products and/or services conform to the contract, the specifications stated in the offer, and reasonable requirements for quality and usability. Defects or incorrect deliveries must be reported in writing within 30 days of delivery. The warranty period corresponds to the manufacturer's warranty. The seller is not liable for the suitability of the products for a particular purpose unless expressly warranted. The warranty is void in the event of unauthorized repairs, modifications, improper use, or failure to follow instructions.



Article 11 – Delivery and Execution

The seller processes orders with the utmost care. Delivery is made to the address provided by the consumer. Delivery takes place within 30 days of the order being placed, unless otherwise agreed. In the event of delays or incomplete delivery, the consumer will be informed no later than 30 days after placing the order and is entitled to cancel the contract free of charge. In the event of cancellation, all payments made will be refunded within 5 business days. If a product is unavailable, an equivalent replacement may be offered. The risk of loss or damage to the goods passes to the consumer upon delivery.





Article 12 – Term, Termination and Renewal

Contracts with an indefinite term can be terminated by the consumer at any time with a maximum notice period of one month. Fixed-term contracts can be terminated at the end of their term with a maximum notice period of one month. Automatic renewal is not permitted, except for newspaper and magazine subscriptions (maximum three months). Contracts with a term of more than one year can be terminated at any time after the first year with a notice period of one month, provided this is not unreasonable.


Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 working days of the start of the cancellation period. The consumer is obligated to inform the seller immediately of any errors in the provided payment details. In case of late payment, the seller is entitled to charge reasonable costs within the legally permissible limits. Your order will be processed by Aurland Atelier and is subject to the laws of Hong Kong SAR.


Article 14 – Complaints Procedure

Complaints must be submitted fully and clearly within 30 days of discovering the defect. The seller will respond to complaints within 30 days of receipt. If a complaint cannot be resolved amicably, the dispute will be subject to arbitration or the jurisdiction of the courts of the Hong Kong SAR. In the case of justified complaints, the seller will, at its sole discretion, provide a replacement or carry out a free repair.


Article 15 – Applicable Law and Jurisdiction

These terms and conditions and all contracts are governed by the laws of Hong Kong SAR. The exclusive venue for all disputes is the competent courts of Hong Kong SAR. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. Mandatory consumer rights of the consumer's country of residence remain unaffected.


Article 16 – Additional Provisions

Should any provision of these Terms and Conditions be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid provision shall be replaced by a valid provision that most closely approximates its intended economic purpose.
The seller reserves the right to amend these Terms and Conditions. Amendments shall apply to orders placed after publication on the website.
These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region.
Aurland Atelier will process your order in accordance with the laws of the Hong Kong SAR.
